Welcome to Element Coffee! By accessing or using our website and services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, please do not use our Services.

1. ACCESS AND ACCOUNT

  • You must be at least 18 years old to use our Services. If you allow any minors to access the Services under your supervision, you confirm that you consent to their use.

  • To make purchases, you may be required to provide accurate and current information, including email, billing, payment, and shipping information. You are responsible for maintaining the security of your account credentials and for all activity on your account.

  • Accounts may not be transferred, sold, assigned, or licensed to any other person.

2. OUR PRODUCTS

  • We strive to provide accurate product descriptions and images. However, product appearance may differ due to screen settings or device types.

  • Product descriptions, availability, and pricing are subject to change at any time. We may limit quantities per person, region, or jurisdiction.

  • Coffee products are perishable. Once delivered, we do not accept returns except for defective, damaged, or incorrect items as outlined in our Return & Refund Policy.

3. ORDERS

  • Placing an order constitutes an offer to purchase. Orders are not accepted until confirmed by Element Coffee and payment is processed.

  • Please review your order carefully; cancellations may not be possible after confirmation.

  • Purchases are for personal use only and not for resale.

  • Your purchases are subject to our Return & Refund Policy, which explains how defective or incorrect products are handled. Nothing in these Terms limits your statutory rights under French or EU law.

4. PRICES AND BILLING

  • Prices, promotions, discounts, and taxes may change without notice. The price charged is that in effect at the time of order confirmation.

  • Shipping, handling, customs, and import charges may apply and are your responsibility.

  • You represent and warrant that payment details are accurate and that you are authorized to use them.

5. SHIPPING AND DELIVERY

  • Delivery times are estimates and not guaranteed. We are not liable for delays caused by carriers, customs, or events outside our control.

  • Title and risk pass to you upon delivery, without prejudice to your statutory consumer rights.

6. INTELLECTUAL PROPERTY

  • All content, logos, trademarks, and materials are owned by Element Coffee, its affiliates, or licensors, and are protected under French, EU, and international intellectual property laws.

  • You may only use our content for personal, non-commercial purposes. Unauthorized use may violate these laws.

  • Feedback you submit grants us a perpetual, worldwide, royalty-free license to use, reproduce, modify, or display such feedback. You confirm you own the rights to your feedback.

7. THIRD-PARTY TOOLS AND LINKS

  • Access to third-party tools is provided “as is” and at your own risk. We are not responsible for third-party websites or their content.

8. RELATIONSHIP WITH SHOPIFY

  • Our Services are powered by Shopify. All sales are directly with Element Coffee. Shopify is not responsible for any aspect of your purchase, including product quality, delivery, or disputes.

9. DISCLAIMER OF WARRANTIES

  • Except as explicitly stated, the Services and products are provided “as is” without warranties of any kind.

  • These disclaimers do not affect your statutory rights under French or EU law, including rights related to defective or non-conforming products.

10. LIMITATION OF LIABILITY

  • To the extent permitted by law, Element Coffee and its partners, affiliates, or Shopify shall not be liable for indirect, incidental, or consequential damages arising from the use of the Services.

  • This does not limit liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law.

11. INDEMNIFICATION

  • You agree to indemnify and hold harmless Element Coffee, Shopify, and affiliates from claims, damages, or costs arising from your breach of these Terms or violation of applicable law.

12. TERMINATION

  • We may suspend or terminate your access at our discretion. Certain sections (IP, feedback, liability, governing law) survive termination.

13. GOVERNING LAW AND JURISDICTION

  • These Terms are governed by French law.

  • EU consumers retain all rights granted by EU consumer protection laws.

  • Disputes are subject to the competent courts in Paris, France.

14. CHANGES TO TERMS

  • We may update these Terms at any time. Material changes will be notified in accordance with applicable law. Continued use constitutes acceptance of changes.
